The EHR giant and the care managed services operator Lumeris signed a decade-long partnership deal to streamline healthcare data exchange, reimbursement cycles via a new health IT product.
This collaboration will also get Cerner $266 million shares in Essence Group Holding, a Lumeris parent company, according to the financial filing. Lumeris also runs EGH’s 65,000 member healthcare plan in Illinois and Missouri.
Maestro Advantage, a new technology, is a result of this new partnership. The technology aims at value-based payment arrangements like Medicare Advantage and provider-sponsored health plans.
The new platform aims to help health systems in improving routine lengthy claim processing, the hassle of dealing with reimbursement cycles, easing the process of sharing data and records, and also improving patient experience and patient outcomes as a whole.
Chairman of Kleiner Perkins and a Lumeris board member, John Doerr said, “The United States health care system’s transition to value-based care has been impeded by disjointed technology, cumbersome processes, misaligned incentives and inadequate management of clinical and financial outcomes. Maestro Advantage lowers the barriers to data transparency and sharing and empowers physicians and health systems,” he added. “However, we know technology alone is not sufficient. Maestro Advantage is an innovative model with supporting processes and expertise to aid long-term success in value-based care arrangements.”
According to Cerner, initial implementations of Maestro Advantage are expected to go live later in 2018. On the other hand, the broad market deployments are scheduled to begin in 2019.
Cerner CEO Brent Shafer also said in a statement, “By using data to reduce or eliminate unnecessary costs and ineffective transitions of care, providing doctors and their patients a more complete view of their medical history and a health plan that consistently receives high-quality scores from CMS, this collaboration with Lumeris aligns well with our mission and illustrates the potential of Cerner technology to positively impact healthcare economics and outcomes in deeper, more impactful ways than before.”
This new strategic partnership will see Lumeris adopting Cerner’s HealthIntent population health technology. The executives from Cerner and Lumeris will work together on business development, client delivery and innovation for Maestro Advantage.

The EHR giant allegedly misclassified some employees and did not pay them overtime salaries. The employees charged Cerner that the company has not been paying the overtime pays. The lawsuit spent 3 years in court before the settlement.
The settlement which Cerner agreed to in April, was approved by Fernando J. Gaitan, Jr., U.S. District Judge for the Western District of Missouri.
Cerner denies any kind of wrongdoing and says that the company has agreed to the settlement to avoid negative public attention and the expense of current lawsuit.

This case was filed back in 2014 when the company was alleged to have violated the Fair Labor Standards Act. According to the lawsuit, the petitioners Mike McGuirk and Fred Speer said that Cerner used “an unlawful company-wide payroll processing system,” and with that processing system “defendant allegedly (1) paid its nonexempt employees’ overtime wages a full pay period late; and (2) systematically miscalculated overtime wages by failing to include all remuneration into nonexempt employees’ regular rate of pay.”
The suit also stated that “Additionally, plaintiff alleges that defendant unlawfully paid plaintiffs and hundreds of other non-exempt employees using the ‘fluctuating workweek’ method of pay, even though those individuals were not paid a fixed salary because they received varying amounts of pay to perform other job functions such as on-call work.”
After the petition was filed, Cerner asked the court that the case should be dismissed immediately on the basis of the following reasons: “(1) named plaintiffs had not filed written consents to join the litigation at the time of filing the motion; (2) the statute of limitations bars named plaintiffs’ two-year FLSA claims; (3) the classes plaintiffs seek to certify are overbroad and the policies identified by plaintiffs do not violate the FLSA; (4) the Court should apply a heightened standard of proof rather than the typical lenient standard; and (5) plaintiffs have not demonstrated that other potential class members have an interest in proceeding with a collective action.”
According to the case, the Cerner employees are hired into three different groups:

  1. Salaried exempt
  2. Hourly non-exempt
  3. Salaried non-exempt

The company hired salary nonexempt workers in above 120 different business units, in 18 states across the country, with hourly non-exempt staff already working in over 200 business units across 32 states, by February 2015.
The petitioners, Speer and McGuirk were working at Cerner’s Columbia, Missouri-based ITWorks division, with the roles of salary non-exempt.
Epic, the electronic health record system vendor recently faced a major labor law case. It was asked that whether the National Labor Relations Act allowed for combined redress in arbitration situations. The case also centered on overtime wages and employment classification.
U.S Supreme Court, on May 21, handed its 5-4 decision on Epic v. Lewis, ruling that companies can require employment and wage disagreements to be hashed out individually, and not permit employees to collectively bring class action litigations against their employers.

As a result, the board is thinking about many options like, the hiring of a new CEO for the company as well as selling, merging or maybe continuing the company as it is. The board said in a statement “sale, merger or other transaction involving the company as well as continuing as an independent company.”
The negative reports about sexual harassment, a leaked video with vulgar comments in 2017 and a 2006 domestic abuse case during a divorce led to Bush’s departure from the company.
The exit comes just after investment experts said that Athena might ignore Elliot’s takeover bid.
Jonathan Bush co-founded this cloud-based top electronic health record and PM system in 1997.
In a statement, Bush said, “I believe that working for something larger than yourself is the greatest thing a human can do. A family, a cause, a company, a country – these things give shape and purpose to an otherwise mechanical and brief human existence. Athenahealth is a near once-in-a lifetime example of such a thing, with that lens on, it’s easy for me to see that the very things that made me useful to the company and cause in these past 21 years, are now exactly the things that are in the way. I cannot imagine a single organization more loaded with potential to transform healthcare.”
The company has started a search of qualified CEO candidates. The board led by former GE CEO Jeffery Immelt said that the company is now working on stabilizing athenahealth’s position in the market.
Marc Levine CFO will take over the operational work, and Amy Abernethy, MD, as the director will advise the leadership team on data strategy, according to the company.
The company said, “There can be no assurance that the review being undertaken will result in a merger, sale or other business combination involving the company. Athenahealth does not intend to make further announcements regarding the review unless and until the Board has approved a specific transaction or other course of action requiring disclosure.”

Senate passed a bipartisan bill on Tuesday, which allows the Medicare and Medicaid centers to offer incentives for behavioral health providers who use EHRs.
This legislation is now headed to the House, where there is already a similar kind of legislation in process.
The purpose of this act is to provide funds to those healthcare providers who were not a part of the previous $38 Billion electronic health record incentive program, with an aim of assisting them to improve care for patients with addiction and psychological illness.
Community health centers, psychiatric and psychologists’ practices were not a part of the program, but the bill introduced in August 2017 by Senators D-Rhode Island, R-Ohio and Sheldon Whitehouse wants to give CMS the authority to distribute incentive payments to all behavioral health providers.
Marry Marran, President and Chief Operating Officer at Providence, R.I.-based Butler Hospital, said in statement issued by Whitehouse, “It’s critical that we have the ability to communicate issues easily and effectively, particularly with primary care providers, and this bill goes a long way towards leveling the playing field and making sure those suffering from mental health issues are not treated differently than anyone else.”
The legislation supported by Senators Debbie Stabenow, D-Michigan, and Bill Cassidy, R-Louisiana, wants CMS to first work on a demonstration test that will provide incentives to healthcare providers for using and implementing EHRs.
This bill is now headed to the House where a similar kind of legislation was introduced by Reps. Doris Matsui, D-California, and Lynn Jenkins, R-Kansas in the last summer, what would allow a trial project to give all the behavioral health facilities money for EHR implementation.
In a statement issued by Senator Whitehouse, he said, “Electronic records help doctors and other providers make better decisions about their patients’ care, Americans who receive substance abuse and mental health treatment should benefit from that technology, too. This bill would test the use of electronic health records by mental health providers to care for patients who too often are left behind.

Ali JK Nutritional Products Ltd, the company which uses Alibaba’s Tmall platform to sell medical products, healthcare devices, adult products etc will be bought by Alibaba Health Information Technology Ltd.
With this deal, Alibaba will now have new shares in Ali Health, which will take firm’s total shares from 48.1% to 56.2% in the healthcare company. The deal will also earn Alibaba a 67.5% voting share in Ali Health.
The deal will surely give a boost to Ali Health’s business and will help the company to grow faster in the healthcare industry as compared to other firms in the market like Ping An Healthcare and Tencent Holdings-backed WeDoctor.
Alibaba’s CEO Daniel Zhang referred to healthcare as “strategically important” business zone for the firm. He said that the deal would prove itself as a “logical evolution” in Alibaba Health’s development. He also said that the deal will help Ali Heath to become country’s “best healthcare ecosystem”.
According to consultancy McKinsey & Co, the deal will help Chinese healthcare expenditure reach $1 trillion mark by the year 2020, rising from $357 Billion in 2011, with huge technology firms ready to enter the rapidly growing private healthcare industry.
Ali Health mentioned in a statement that, after injecting of the business unit, Ali Health produced a gross stock of almost 20.56 billion Yuan ($3.21 billion) in the fiscal year to March 31 and had more than 3,300 related dealers.
Alibaba said that the deal is waiting for an approval of the transaction by shareholders of Ali Health and Hong Kong stock exchange.

According to the agency officials, the new leadership is “now firmly aligned” with the short-term priorities of the President, including Electronic Health Record modernization.
VA press secretary Curt Cashour , in a written statement said, “In a number of cases, employees who were wedded to the status quo and not on board with this administration’s policies or pace of change have now departed VA, under Acting Secretary Wilkie’s leadership, senior VA officials are now on the same page, speaking with one voice to veterans, employees and outside stakeholders, such as Congress and veterans service organizations, and are focused on a number of key priorities in the short term.”
One thing that Cashour didn’t mention was whether, Veteran Affairs’ decision on the modernization would follow the decision made by Shulkin in June 2017 to completely replace legacy Veterans Health Information Systems and Technology Architecture with Cerner’s off the shelf commercial system, or to stick with decade old VistA and upgrade it.
The VA has been in $10 billion EHR modernization contract negotiations with Cerner, which has not been signed yet. Shulkin’s firing has effectively left the deal in awkward situation. Shulkin told VA to create a single common EHR system with DoD, which would use a shared Cerner Millennium EHR platform. The agency also announced its plan to align implementation and deployment with Department of Defense’s own Cerner System, which has already been installed in the Pacific Northwest at four military sites.
Some people are still questioning the VA’s decision to adopt a Cerner system, one DoD officials are confident that the agency is definitely going to sign a deal with the top EHR vendor. An executive program officer for Defense Healthcare Management Systems, Stacy Cummings, on Thursday testifying before a Senate appropriations subcommittee, said that her agency has “regular engagement” with the Veteran Affairs to discuss finalize strategies for Cerner acquisition.
“We meet regularly, we share lessons learned, we talk about the technology implications,” said Cummings, who also said that despite the changings in VA’s leadership, VA-DoD meetings never stopped, and from her perspective VA’s “still moving the ball forward.”
Cashour’s announcement on Wednesday indicated that VA has also been working very closely with the White House to nominate Rear Admiral Ronny Jackson as agency’s next secretary. But Jackson withdrew his nomination after a senate committee delayed his confirmation hearing, to investigate the allegations of management issues and improper behavior.

The Defense Department’s migration to Cerner is going at a good pace and the Defense Health Agency (DHA) is gathering information on ways of best managing and migrating its data to the new EHR.
The DHA has already sought assistance from its industry partnership network regarding the colossal data migration challenges it’s currently facing in its big EHR modernization move. The said move is expected to continue over to the next decade and will grow even more complex as it adds the Coast Guard with it. An integration with the Veteran Affairs is also expected in the future.
A statement from the DHA Officials states, “coordination of reference data tables and mapping of data elements is necessary to ensure consistent and accurate measurement capability and semantic interoperability between component systems through this transformation.”
DHA claims that it is now very interested in knowing more about quality tools that can assist it in managing enterprise data management systems for the MHS. It is also looking at ways that would facilitate its ability to meaningfully share medical data between its current EHR systems and the data management systems of its new commercial EHR.
According to a reliable news source, the existing data systems of DHA currently maintain medical records of a little over 20 million people. Revealing further information on the mentioned health data, DHA officials said, “Much of the data is in standard code sets (ICD9, ICD10, CPT, MEDCIN, etc.) but there are also tables of system specific institutional data.”
With the expansion of MHS Genesis along with the added complexity brought up by the Coast Guard and VA integration, the variety and volume of medical data are expected to increase substantially in the years ahead.
“As the new EHR generated health data begins to predominate over the next few years, DHA will need reference and metadata management systems able to relate national standard terminology to MHS system usage, and to enable proactive management of measurements from the clinicians’ desktop to enterprise dashboard presentation,” the agency said adding, “The anticipated increase in clinical data from the new EHR, and the need to integrate decades of historical health and business system data, will require a robust enterprise reference and metadata management system.”
